Letter of Administration
An application for Letters of Administration is a probate application where the deceased did not make a Will. Therefore it will be issued to the next of kin. This isn’t always automatic, so if necessary you would need to apply to the Court for Letters of Administration.
Letters of Administration is not a letter that a Probate Solicitor can simply and easily give you. It is a Grant issued by the Probate Registry. Banks, insurers and other institutions will ask to see it before they release funds, in the same way they ask to see a Grant of Probate when there is a Will.
The person named on the Grant becomes the administrator of the estate. They can collect assets, pay debts and tax, and then distribute what remains. Unlike an executor, they have no Will to follow, so the estate is shared under the Rules of Intestacy.
